Oklahoma Sues Contractor Following Fire at Sequoyah Lodge

The state of Oklahoma has initiated legal action against The Lookout Kitchen, RPW ENT, LLC, and RCC Ventures LLC after a fire at the Sequoyah State Park lodge and restaurant caused significant damage. The lawsuit, filed on November 25 in Oklahoma County District Court by the Office of Management and Enterprise Services on behalf of the Oklahoma Department of Tourism and Recreation, alleges breach of contract and negligence, seeking over $5 million in damages.

The fire, which occurred on December 14, resulted in approximately $4.5 million in damages, primarily affecting the kitchen and hotel rooms of the lodge. According to the lawsuit, the fire was ignited when an employee of RPW improperly disposed of a rag containing greasy and combustible materials, leading to a fire that spread throughout the facility. Fortunately, the local volunteer fire department reported that the fire was contained to the kitchen and dining area, with no injuries reported.

The Oklahoma Department of Tourism and Recreation had contracted RPW to manage restaurants in six state parks, including Sequoyah State Park. The lawsuit claims that RPW failed to secure the required insurance for the restaurant, which is a breach of their contractual obligations. Following the fire, the state announced that the restaurants in the parks would be closed due to ongoing disputes with The Lookout Kitchen. Although the lodge reopened in May, the restaurants were closed again permanently in September.

This lawsuit is not the first instance of legal conflict between the state and a vendor managing park restaurants. In 2022, the state canceled its contract with Swadley’s Foggy Bottom Kitchen and subsequently sued the company for breach of contract, seeking to recover millions. Swadley’s countered with a lawsuit claiming the state owed them nearly $2.6 million. In 2024, three individuals, including Swadley’s founder Ronald Brent Swadley, were indicted on charges related to conspiracy to defraud the state and presenting false claims.

In a statement regarding the recent fire, tourism officials noted the extensive damage and the ongoing legal proceedings. JP Wilson, the owner of The Lookout Kitchen, previously claimed that the restaurant was insured and that the damage was minimal, asserting that the decision to reopen the restaurant rested with the state.
