Former special counsel Jack Smith has formally requested the release of his full deposition video to the House Judiciary Committee. On December 18, Smith's attorneys, Lanny A. Breuer and Peter Koski, sent a letter to Committee Chair Jim Jordan (R-Ohio) advocating for the public disclosure of the recording. They emphasized that this would allow the American public to hear the facts directly from Smith, rather than relying on second-hand accounts.

He stated, “Our investigation developed proof beyond a reasonable doubt that President Trump engaged in a criminal scheme to overturn the results of the 2020 presidential election and to prevent the lawful transfer of power.” Smith also highlighted evidence indicating that Trump willfully retained classified documents after leaving office and attempted to obstruct justice regarding their retention.
