New York's Initiative to Track AI-Related Layoffs

Since March 2022, over 160 companies in New York state, including major employers like Amazon and Goldman Sachs, have filed notices of mass layoffs. Notably, none of these companies attributed their workforce reductions to "technological innovation or automation," despite the increasing adoption of AI tools in various sectors. This lack of attribution raises questions about the transparency of layoffs linked to technological advancements.

In response to the growing concern over the impact of AI on employment, New York Governor Kathy Hochul mandated that the Department of Labor include an option for companies to specify if layoffs were due to AI or automation in their Worker Adjustment and Retraining Notification (WARN) filings. Companies are now required to select from a list of 17 reasons for layoffs, which includes options like "bankruptcy," "merger," and "relocation." If a company indicates that technology is a factor, they must further specify the type of technology involved, such as AI or robotics.
