History

Historical Context

The 1965 Voting Rights Act required jurisdictions with histories of discrimination to obtain federal preclearance under Section 5, enforced by the Section 4(b) coverage formula. In 2013 the Supreme Court’s 5-4 decision in Shelby County v. Holder invalidated that formula, ending preclearance for 13 states and spurring polling-place closures. The 2023 6-3 ruling by Justice Alito that struck down the 1982 amendment revives those concerns.
