Historical Context

In 1993 the Supreme Court issued a 5-4 ruling in Shaw v. Reno, finding North Carolina’s 12th district unconstitutional under the Equal Protection Clause. The decision stemmed from the 1990 census, which added one congressional seat to the state and triggered redistricting. Today South Carolina Governor Henry McMaster and Shane Massey are drawing maps to oust Rep. James Clyburn, aware Shaw v. Reno may again require judicial review.
