Historical Context

In 1986 Congress enacted the Commercial Motor Vehicle Safety Act, which required a federal Commercial Driver’s License and gave the FMCSA authority to set uniform knowledge tests. The FMCSA’s General Knowledge Test contains 50 questions, and applicants must answer at least 80 percent correctly. Secretary Sean Duffy now cites that authority while charging Jing S. Dong over the I-95 bus crash that killed five.
