Lawsuit Claims SpaceXAI and Stability AI Enabled Creation of Child Sexual Abuse Images

A revised complaint adds two new plaintiffs—one from Wyoming and one from Wisconsin—to a class action originally filed by three Tennessee teenagers. The five plaintiffs, identified only as Jane Does, allege that SpaceXAI’s chatbot Grok and Stability AI’s Stable Diffusion tools were used to transform childhood photographs into thousands of sexually explicit images and videos. In one instance, a stepfather allegedly generated about 7,000 explicit depictions of a girl who was roughly 11 years old. The suit accuses the companies of producing CSAM, profiting from sex-trafficking ventures, negligent product design, and creating a public nuisance.

AI-driven image-generation tools have existed for years, but the practice of producing non-consensual intimate images surged in 2025 after major firms such as Google, OpenAI and xAI (now SpaceXAI) updated their models to allow “bikini-strip” prompts. The surge prompted investigations and temporary bans in Indonesia, Malaysia and the United Kingdom. Unlike proprietary models, Stability AI’s open-weight models are easier to modify, allowing users to remove safety restrictions.

SpaceXAI, required by law to report suspected CSAM to the National Center for Missing and Exploited Children (NCMEC), allegedly sent only a single tip in February and failed to provide the perpetrator’s IP address or the abusive images themselves, despite multiple law-enforcement requests. The complaint notes that law-enforcement later charged the stepfather with child-exploitation offenses; he died by suicide two days after his devices were searched. Stability AI is accused of rolling back guardrails on its newer models to increase user adoption, despite earlier efforts to filter NSFW content.

Plaintiffs’ counsel argues that both companies prioritized profit over safety, allowing the creation and distribution of exploitative imagery. The lawsuit contends that Stability AI could have restricted its models but chose not to, and that SpaceXAI’s reporting practices fell short of statutory expectations.
