The 1996 Illegal Immigration Reform and Immigrant Responsibility Act, signed by President Bill Clinton and effective April 1 1997, expanded mandatory detention and funded a $12 million, three-layer fence near San Diego plus at least 1,000 new border agents each year through 2001. Two decades later, the 9th U.S. Circuit Court, in a 2-1 opinion by Judge Daniel Bress, struck down the Trump administration’s bond-denial rule, reviving DHS-required bond hearings.
