The Appeal Against NHS Fife’s Tribunal Decision
Nurse Sandie Peggie has been granted permission to appeal the employment-tribunal judgment that found NHS Fife had harassed her on four counts. The Employment Appeal Tribunal (EAT) ruled on 30 July 2026 that there are reasonable grounds to bring 13 grounds of appeal. A notice of appeal dated 19 January 2026 was served on the health board, which now has 28 days to respond. The full hearing is expected in the first half of 2027.
Background of the Dispute
Peggie was suspended after objecting to sharing a female changing room with Dr Beth Upton, a transgender doctor who identifies as a woman, at Victoria Hospital in Kirkcaldy on Christmas Eve 2023. Peggie lodged claims under the Equality Act 2010, alleging sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. The original tribunal issued its judgment on 8 December 2025, finding NHS Fife had harassed Peggie by failing to revoke Dr Upton’s permission to use the changing room, (2) taking an unreasonable time to investigate, (3) referencing patient-care allegations, and instructing her not to discuss the case until a later clarification. All other discrimination claims, including those against Dr Upton, were dismissed. The judgment was amended on 11 December and 23 December 2025.
Official Statements & Responses
Peggie’s legal team announced on 3 August 2026 that the appeal will proceed to a full hearing. In a press statement, Peggie reiterated her resolve: “Their judgment, I believe, falls short in many respects and that is why I certainly won’t be giving up this legal fight any time soon.” — NHS Fife. However . Judge James Tayler of the EAT affirmed that the appeal is grounded on the 13 identified points.
