Historical Context

The modern Haitian TPS began after the 1990 coup, when Congress added Section 244 to the Immigration and Nationality Act and granted refuge to roughly 70,000 Haitians. By 2026 the program covered about 350,000 Haitians within a 1.3 million-person TPS pool. On June 25 2026 the Supreme Court, led by Chief Justice John Roberts and Justice Samuel Alito, ruled DHS could end the Haitian designation, reviving congressional battles over its future.
