History

Historical Context

After HHS added gender-identity protections to the ACA’s Section 1557 in 2014, Medicaid began spending about $2 billion a year on gender-affirming care for an estimated 1.4 million transgender Americans. Beginning in 2017, the Trump administration rolled back related rules—bathroom, military and employment protections—and on October 13 2026 issued an order ending that coverage, prompting lawsuits from groups such as the Human Rights Campaign.
