Oklahoma Insurance Commissioner Sued Over Unreleased State Farm Roof-Claims Investigation

Craig and Elizabeth Gutierrez of the Rose Creek neighborhood filed a lawsuit in Oklahoma City seeking a court order that requires Insurance Commissioner Glen Mulready to release the final findings of a two-year market-conduct examination into State Farm Insurance’s handling of roof claims. The couple alleges State Farm denied a roof replacement after their home suffered three-inch hail in September 2024 and contend that the pending report could be “critical” to their ongoing legal dispute with the insurer.

The Oklahoma Insurance Department began the examination after numerous policyholders reported denied or underpaid roof repairs following the 2024 hailstorm. Mulready previously told the public the report would be published by March 31 of this year, but the independent examiner has not yet submitted a final document, leaving the investigation incomplete.

Mulready responded that the lawsuit is “frivolous” and reflects either a misunderstanding of Oklahoma insurance law or an attempt to pressure the agency into releasing an unfinished examination. He emphasized that the department’s duty is to conduct a thorough, evidence-based review, not to produce a report on demand for private litigation, and warned that “taxpayer resources” are being diverted by the suit.

Attorney Lauren Guhl of Whitten Burrage, representing the Gutierrezes and hundreds of other State Farm policyholders, argued that Mulready has ignored multiple FOIA and open-record requests and that the public deserves access to the investigation’s findings.
