Court Accepts Bankruptcy Petition for Evergrande’s Main Onshore Unit
The Guangzhou Intermediate People’s Court announced on Friday that it had accepted a bankruptcy liquidation application filed by the Huaxia sub-branch of Guangzhou Rural Commercial Bank Co Ltd. The decision closes the final chapter of the developer’s prolonged collapse.
Founder Hui Ka-yan (Xu Jiayin) Sentenced to Life Imprisonment
A day earlier, the Shenzhen Intermediate People’s Court sentenced Hui Ka-yan—also known as Xu Jiayin, the billionaire founder of Evergrande—to life imprisonment on multiple financial-crime charges, stripped him of political rights for life, and ordered the forfeiture of all personal property. The court also imposed administrative fines of 8.82 billion yuan on China Evergrande Group and 7 billion yuan on Evergrande Real Estate, with orders to recover remaining illegal gains. A photo of Hui in the Shenzhen courtroom was released on August 20.
Legislative Overhaul of China’s Insolvency Framework
The liquidation filing coincided with proposed revisions to China’s Enterprise Bankruptcy Law. Huang Haihua, spokesman for the Legislative Affairs Commission of the National People’s Congress Standing Committee, outlined draft amendments that aim to strengthen temporary protection for restructuring, clarify filing criteria, mandate stricter information disclosure, and improve cross-border bankruptcy rules. The second reading of the reforms is scheduled for August 25–28.
Wider Impact and Context
Evergrande’s default on more than US$300 billion in liabilities in 2021 triggered a systemic property downturn, sparked widespread home-buyer protests over unfinished projects, and led to a Hong Kong court ordering liquidation of its offshore holding company in early 2024. The rapid succession of the founder’s sentencing and the liquidation order underscores Beijing’s determination to resolve the years-long debt crisis that once made Evergrande the poster child of China’s leveraged property boom. An aerial view of an Evergrande residential complex in Nanjing was captured on August 21, 2026.
