AfCFTA’s Transition From Treaty to Working System

Background & Context
The African Continental Free Trade Area (AfCFTA) was signed in Kigali in 2018, entered into force in 2019, and began operating in January 2021. Fifty-four of the African Union’s 55 members have signed the agreement; Eritrea remains the sole non-signatory. By July 2026, 49 countries had deposited their instruments of ratification. The World Bank estimates the market covers roughly 1.3 billion people and about $3.4 trillion in GDP; Africa’s population has since risen above 1.4 billion.
Operational Milestones
- Certificates of origin – More than 12,000 certificates had been issued by March 2026, certifying goods for preferential tariff treatment.
- Customs-modernization concession – In August 2026 the Secretariat signed a 20-year, $3.1 billion concession with Nigerian firm Bergmans Security Consultants and Supplies Ltd. The project will deliver digital customs tools, electronic information exchange, one-stop border posts, cargo tracking, multilingual portals, data centers and risk-management systems across participating countries.
- Pan-African Payment and Settlement System (PAPSS) – By July 2026 PAPSS linked 28 African countries, more than 190 commercial banks and fintech firms, and 16 payment switches, enabling cross-border payments in African currencies.
- Digital-trade protocols – The African Union adopted the AfCFTA Protocol on Digital Trade in February 2024 and approved eight annexes in February 2025 covering digital identities, cross-border payments, data transfers, fintech, online safety, cybersecurity and advanced technologies. National ratification remains uneven.
- Digital Trade Forum – At the Lagos forum on July 1-2 2026, officials, regulators, investors and entrepreneurs convened to advance digital-trade commitments.
Data & Statistics
- SME capacity building – Over 7,500 small and medium-sized enterprises in 19 countries received training on cross-border digital trade, cloud technology and artificial intelligence between November 2025 and June 2026.
- PAPSS reach – Active in 28 countries, connecting over 190 banks/fintech firms and 16 payment switches as of July 2026.
Institutional Challenges
Customs
Member states retain separate customs administrations and systems, leading to incompatible forms, delayed inspections and divergent acceptance of electronic documents. The concession provides financing but does not compel uniform adoption.
Payments
PAPSS expands technical connectivity, yet settlement, liquidity, anti-money-laundering controls and dispute-resolution mechanisms must be harmonized among central and commercial banks. Companies remain cautious about high-value transactions until reliability is proven.
Digital Trade & Legal Frameworks
The protocols address consumer protection, privacy, taxation and cybersecurity, but national ratification is incomplete. Questions persist about applicable consumer rules, liability for failed payments and verification of electronic invoices.
Investment, Competition and Intellectual-Property Rules
Protocols adopted in 2023, with IP annexes finalized in February 2026, face implementation gaps that create uncertainty for investors and governments seeking predictable dispute-resolution and protection of domestic industries.
Conflicting Reports & Gaps
Sources confirm certificates of origin are being issued, but there is no quantitative evidence that border-clearance times have decreased or that tariff reductions are fully realized. The impact of the customs-modernization project on procedural consistency remains unmeasured.
What’s Next
Progress will be judged by additional ratifications, incorporation of protocols into national law, the volume of payments processed through PAPSS, utilization of preferential tariffs, and the extent to which the customs-modernization project reduces clearance delays. Ongoing coordination among customs authorities, banks, regulators and private firms will be essential to transform AfCFTA from a treaty into a functional single African market.
