Network Rail sues DB Cargo UK and Touax over 2020 fuel-spill derailment

Network Rail, the owner and operator of Britain’s railway infrastructure, filed a legal claim earlier this month against DB Cargo UK and Touax Rail. The claim seeks more than £5 million in damages for negligence related to a derailment that occurred in August 2020 near Llangennech, Carmarthenshire. Ten of the 25 wagons on the freight train left the track, spilling roughly 446,000 litres of fuel.
Environmental impact and recovery
The spill ignited 116,000 litres of fuel, and the remaining 330,000 litres flowed into adjacent wetlands that are designated as a Site of Special Scientific Interest (SSSI) and a Special Area of Conservation. About 300 residents were evacuated, and firefighters spent nearly two days extinguishing the blaze. The line remained closed for six months and did not fully reopen for almost a year; roughly 30,000 tonnes of fuel-soaked soil had to be excavated.
Findings and recommendations
The Rail Accident Investigation Branch (RAIB) reported in January 2022 that the train was travelling at about 38 mph and was carrying up to 75.5 tonnes of fuel. The investigation identified a wheel set on one wagon that locked, likely due to a brake defect arising from design and maintenance deficiencies. While the RAIB did not assign legal blame, it issued nine safety recommendations aimed at preventing similar incidents.

Network Rail’s legal filing states that it expects to recover more than £5 million from the two defendants. Lawyers for Network Rail emphasized the claim’s basis in negligence and contractual breach. Both Network Rail and DB Cargo declined to comment on the lawsuit, and Touax has been approached for comment but has not responded publicly.

A court hearing has not yet taken place, and the defendants have not filed defenses. The outcome of the case will determine the extent of financial liability for the parties involved and may influence future maintenance standards for freight wagons operating on the UK rail network.
