Ashlyn Nassif Sentenced After Falsifying Documents for $150 Million Loan Amid Allegations of Paternal Pressure

Ashlyn Nassif, 32, pleaded guilty in June to providing false or misleading information to obtain a $150 million construction loan from Westpac that financed three apartment towers in Sydney’s north-west in 2021. The judge also noted her major depressive disorder at the time of the offence.

Lawyer Murugan Thangaraj SC argued that Ashlyn acted under the “sway” of her father, fugitive developer Jean Nassif, who allegedly pressured her to falsify the loan documents. Thangaraj described a pattern of coercive control, citing the father’s demands that his daughter lose weight or undergo cosmetic surgery to “look better” for public display. The defence maintained that without her father’s influence she would not have committed the offence.

Jean Nassif, 58, fled Australia for rural Lebanon in 2022 after the collapse of his firm Toplace. The NSW Independent Commission Against Corruption (ICAC) is probing alleged $2 million payments to NSW Liberal powerbrokers that may breach the NSW Electoral Funding Act. A warrant has been issued for Nassif’s arrest, and 57 companies linked to Toplace are currently in administration.

Judge Halburd stressed that Ashlyn’s sentencing should be viewed independently of her father’s broader alleged misconduct. Thangaraj, addressing the court, condemned the father’s decision to leave his daughter to face charges “for his company’s benefit,” questioning his character. Jean Nassif, via video link, claimed he was “desperate” for the Westpac loan but produced a medical certificate to avoid appearing in person.
