History

Historical Context

The 1975-77 Emergency, imposed by Prime Minister Indira Gandhi, suspended civil liberties for 21 months and saw 34,988 arrests under the MISA law. After the Janata Party’s 1977 victory ended that authoritarian spell, India’s courts regained independence. On September 2, the Bombay High Court ordered a CBI takeover in the Salian case, reviving fears of political interference reminiscent of the Emergency.
