Complaint Over Targeted Equity Programs
Defending Education, a nonprofit founded in 2021 and backed by conservative philanthropies, lodged a federal civil-rights complaint with the U.S. Department of Education’s Office of Civil Rights. The group seeks an investigation into whether these initiatives constitute unlawful discrimination.
District’s Equity Initiatives and Their Origins
OUSD’s Office of Equity, created in 2016, administers a suite of programs for African American, Arab American, Pacific Islander, and Latino students. The Latino men and boys program later expanded in 2019 to include girls and nonbinary youth, giving rise to the Latinx mentoring program. The district contracts with the Unity Council, a Fruitvale-based organization, to run the Latino men and boys program at four middle schools and two high schools and the Latinx mentoring program at three high schools. The Office of Equity’s 2025 report argues that “race-neutral approaches are not sufficient” to address historic discrimination and that “intentional, tailored, targeted measures” are required.
Performance Gaps and Program Outcomes
State test data show that roughly 33 % of OUSD students meet grade-level standards in reading and 27 % in math, compared with 22 % and 15 % respectively for Latino students, and 21 % and 13 % for Black students. In 2024, the graduation rate for Latino students was 68 %, versus 74 % overall. The district cites program impact: in January 2024, 78 % of participants in the Latino student achievement program recorded attendance rates of 95 % or higher, versus 39 % of Latino students district-wide.
Official Responses and Ongoing Investigations
OUSD declined to comment on the complaint. The Office of Civil Rights currently has an open investigation into a separate allegation that a December 2023 pro-Palestinian teach-in discriminated against Jewish students. The New York Times has reported that the Office of Civil Rights has opened nearly a dozen federal investigations following Defending Education’s complaints about diversity and inclusion programs.
