A class-action lawsuit alleged that CVS Health disclosed personal data collected on its website to advertising firm Criteo. While CVS maintains it has not violated any laws, the company agreed to resolve the case through a $20.5 million settlement that provides direct payments to qualifying customers.

Who Qualifies

CVS Digital Properties include the CVS.com website, the CVSHealth.com site, and the CVS mobile app. Any use—such as scheduling a vaccine appointment, checking a prescription, ordering products, printing photos, or other activities—meets the criterion.

Claim Process and Payment Options

Eligible individuals may submit a claim online or by mail. The claim form asks claimants to upload proof of website or app use, such as browser history, screenshots showing dates, or email receipts of online purchases. Claimants who provide such evidence can receive a $10 payment; those who cannot substantiate their use may still receive a $5 payment. The filing deadline occurs in mid-November, after which no further claims will be accepted. Approved claimants can elect to receive their payment via PayPal, Venmo, or Zelle.

CVS has publicly stated that it “has not violated any laws,” yet chose to settle the matter to avoid prolonged litigation and to provide restitution to affected customers.

Next Steps

A final approval hearing is scheduled for early December. Assuming the court approves the settlement, payments will be processed to claimants through the selected electronic-transfer methods.
