The dispute originated from a challenge by the Hong Kong Golf Club, which operates the Fanling Golf Course, against the government’s endorsement of an environmental impact assessment (EIA) report. The club argued that additional information was inserted into the EIA without public consultation. The appellate judges found this omission created “unfairness” in the overall consultation process and noted failures to meet wildlife-conservation objectives. The ruling clarified that not every amendment to an EIA automatically triggers a new public consultation; each case will be judged individually.
Official Responses and Housing Targets
Chief Executive John Lee stated that the setback would not markedly affect overall housing supply. Housing chief Winnie Ho expressed confidence that the average waiting time for a public rental flat could be reduced to 4.5 years before the current administration’s term ends in June of next year. The current average waiting time stands at roughly four years.

The abandoned appeal puts the 12,000-flat scheme in doubt and is expected to prompt fresh public consultations on the 9.5-hectare (23.5-acre) parcel earmarked for development.
