Historical Context

On 25 June 1975 President Fakhruddin Ali Ahmed, on Prime Minister Indira Gandhi’s advice, invoked Article 352 to impose a national Emergency, suspending civil liberties and censoring the press. With a two-thirds parliamentary majority, Gandhi ordered the Delhi Police to detain over 100,000 opposition activists and later enacted the 42nd Amendment, reshaping the Constitution. The episode later prompted the Supreme Court’s basic-structure doctrine.
