Since 2 August the EU AI Act’s Article 50 obliges systems that interact directly with people to disclose that the interaction is with an AI, unless the AI nature is obvious to a reasonably well-informed person. The rule applies to providers both inside and outside the EU and imposes fines of up to EUR 15 million or 3 % of worldwide turnover for non-compliance. Instinct has not publicly confirmed whether it operates in Europe, but the regulation’s scope would bind the company if it offers its agent to EU users.
