The panel concluded that the district court’s order improperly addressed a disputed contract-interpretation question—whether the parties’ communications automatically extended the CBA—rather than the underlying issue of whether the VA’s initial termination was unlawful.

Prior Legal Battles

The dispute dates back to an August 2025 effort by the VA to cancel the AFGE contract, which DuBose ruled likely violated union members’ First Amendment rights. She issued an injunction and a subsequent enforcement order that required the VA to reinstate the CBA. The VA appealed, and the appellate panel previously upheld most of DuBose’s rulings while noting it could not compel the department to comply with specific contract terms. In July, the VA announced it would allow the agreements to lapse when they expire in August, arguing that the contract’s automatic-extension clause had been triggered. The union contested this, asserting that negotiations on a new deal had already begun, which under the contract would extend the expiration date.

Reasoning Behind the Stay

The appellate judges wrote that DuBose’s determination about the automatic-extension clause constituted a compliance question beyond the scope of the original injunction. They emphasized that the district court’s preliminary injunction directed the VA to “reinstate” the CBA as a binding agreement, but left open how compliance with individual provisions would be judged. Accordingly, the panel found it improper to alter that injunction while it remains under appeal.

Implications and Outlook

The stay leaves the status of the VA-AFGE contract unresolved, preserving the district court’s earlier order that the agreement remain in effect. The VA must continue negotiations under the existing CBA while the broader legal question of whether the department can lawfully terminate the contract remains pending before the appellate court.
