History

Historical Context

The 1984 Baby Doe Amendment, added to the 1974 Child Abuse Prevention and Treatment Act, required states receiving federal child-abuse funds to report medical neglect of disabled newborns, defining withholding treatment as abuse unless the infant is comatose or care is virtually futile. It followed cases such as Indiana’s 1982 Baby Doe and New York’s 1983 Baby Jane Doe, and is cited in the Arcadia mansion surrogacy abuse investigation.
