History

Historical Context

In June 1975 Prime Minister Indira Gandhi invoked Article 352 to impose a national Emergency, suspending civil liberties and detaining more than 100,000 opponents, including future Janata leader Morarji Desai. The episode reshaped India’s constitutional safeguards, prompting later amendments that protect fundamental rights. In October 2026 Delhi Police’s detention of Rahul Gandhi and other protesters echoes that historic pattern of high-profile arrests.
