Historical Context

In 1961 the U.S. Army hanged Private John A. Bennett, the last military execution, ending a series of 160 executions carried out between 1942 and 1961. After the 1983 court ruling and 1984 reinstatement, President Donald Trump authorized firing-squad executions in 2026, scheduling former Major Nidal Hasan for December 3, 2026. The upcoming firing-squad ties today’s case to the use of capital punishment in military law.
