History

Historical Context

India’s 1975 Emergency, declared by Prime Minister Indira Gandhi, suspended democratic rights and led to mass arrests of political opponents. The government detained over 1,000 opposition leaders, including Janata Party founder Morarji Desai, while the Supreme Court of India later ruled the detentions unconstitutional. Today, Delhi Police’s pre-emptive detention of CJP leaders Abhijeet Dipke, Saurav Das, and Ashutosh Ranka mirrors the Emergency’s use of security measures to curb dissent. Such parallels warn that repeated suspension of civil liberties can erode judicial independence and embolden future administrations to impose similar restrictions.
