OCI Cardholder Imran Khan’s Detention Sparks Legal Debate in Mumbai

Background & Context
The Overseas Citizen of India (OCI) scheme, introduced in 2005, grants foreign nationals of Indian origin a lifelong multiple-entry visa and certain privileges in education, property and professional activities. OCI holders remain foreign nationals; they cannot vote, contest elections or claim political rights reserved for Indian citizens. The restrictions are set out in the Citizenship Act, 1955 and related rules issued by the Centre. While the Act does not expressly forbid attending a public protest, the Constitution’s guarantees of freedom of speech and assembly under Article 19 apply only to Indian citizens, not to OCI cardholders.
Protest and Detention
On October 10, a demonstration was held at Mumbai’s August Kranti Maidan in support of the Cockroach Janta Party’s call for a protest in New Delhi. More than 400 participants were detained after police determined that no permission had been obtained. The Bombay High Court’s directions limit protests to Azad Maidan, and the Mumbai Police said they could not grant permission for the August Kranti Maidan gathering. The protest was organized by Tushar Gandhi, great-grandson of Mahatma Gandhi, who was also detained and later released.
Official Statements & Responses
Bharatiya Janata Party (BJP) leader Kirit Somaiya wrote to Mumbai Police Joint Commissioner Manoj Kumar Sharma, asserting that Imran Khan is a “foreign citizen” and demanding his arrest and deportation for allegedly violating OCI provisions and visa conditions. He claimed the actor misused his OCI status to take part in an “illegal political agitation.”
Mumbai Police confirmed that the protest lacked required permission and that the detention of participants, including Khan, was carried out in accordance with existing immigration and public-order laws.
Verbatim Quotes
- “The citizens of India cannot tolerate the political extremism that Imran Khan has been displaying during his recent stay in the country. He is an American citizen holding an OCI card, yet he has attempted to misuse his status. Today, we submitted all proofs and evidence to the police regarding his conduct—specifically the speeches he delivered during the protest and his earlier comments,” — Kirit Somaiya
- “I don't have any right to demand anything from people. I am not a part of any organisation. I will stand as a representative.” — Imran
