UK Courts Hand Down Prison Sentences for Careless and Dangerous Driving

By Drooid · · How we work

Core Cases and Sentences

Four recent Welsh and Northern Irish court hearings illustrate how UK judges are responding to serious road-traffic offences.

  • David Dowling of Caerphilly was driving at 76 mph in wet, windy conditions when his vehicle aquaplaned and struck a stationary Audi A3, killing passenger Sharon Berry. Dowling pleaded guilty to causing death by careless driving and two counts of causing serious injury by careless driving. He received a 27-month prison term, suspended for two years, a four-year driving disqualification, 250 hours of unpaid community work and £1,630 in prosecution costs.
  • Lewis Burtney, 23, was travelling at more than 100 mph on the A1 when his speed caused a collision that killed James Smyth and seriously injured four women, one now using a wheelchair. The Downpatrick Crown Court sentenced Burtney to five years’ imprisonment, to be served half in prison and half on licence conditions, and imposed a six-year driving ban.
  • Grzegorz Brylowski, 42, of Dunfermline, lost control of a red Audi R8 after clipping a kerb. The car split in half; the driver suffered a fractured pelvis and required 26 screws and plates, while an 11-year-old passenger escaped uninjured. Sheriff Krista Johnston endorsed a licence with nine penalty points, imposed a £1,040 fine and warned him to drive with “extreme care in future.”
  • Catriona Mason, 65, who has multiple sclerosis, crossed the carriageway on the A252 near Canterbury on 31 January 2025 and collided head-on with Richard Perfect, who sustained multiple injuries and remains on crutches. Mason pleaded guilty to causing serious injury by careless driving. District Judge William Nelson handed an 18-week custodial sentence suspended for 12 months, citing her remorse and medical licence compliance.

Timeline

  • 31 January 2025 – Mason’s collision with Perfect.
  • 6 October – Mason appears at Folkestone Magistrates’ Court for sentencing.
  • Early November – Brylowski admits careless speed on the A92.
  • (Date unspecified) – Dowling’s sentencing.
  • (Date unspecified) – Burtney’s sentencing.

Official Statements & Responses

  • District Judge William Nelson noted Mason’s age, lack of prior convictions and medical licence, concluding that a suspended sentence was appropriate given her “obvious remorse.”
