History

Historical Context

The 1973 Miller v. California decision, issued by the U.S. Supreme Court, established the three-prong test for obscenity, reshaping broadcast standards. Following the ruling, the Federal Communications Commission logged 1,500 indecency complaints in 1974, prompting NBC and CBS to tighten pre-air script reviews. Similarly, NBC’s 2019 clearance of Shane Gillis’s gym-attire joke and the subsequent FCC-cited profanity apology echo the network’s historic cautionary stance. The legacy of Miller’s precedent continues to force comedians and networks to balance edgy material against regulatory risk, influencing future content-approval protocols.
