Historical Context

In 2005 Parliament of India passed the Foreigners (Amendment) Act, creating the Overseas Citizenship of India (OCI) scheme under the Citizenship Act, 1955. The 2015 amendment exempted certain Bangladeshi, Pakistani and Afghan minorities, and the 2019 Citizenship Amendment Act tightened refugee criteria. On October 28, FRRO and BJP member Kirit Somaiya ordered actor Imran Khan’s expulsion, invoking the 2005 provision to revoke OCI status for immigration violations.
