History

Historical Context

Congressional privacy rules trace back to Katz v. United States (1967), which overruled Olmstead and held that warrantless electronic eavesdropping violates the Fourth Amendment’s reasonable-expectation-of-privacy test. The decision spawned the exclusionary rule and later cases like United States v. U.S. District Court (1972). Today, Apple’s Watch Series 12 and Amazon’s Bee Frontier wristband face scrutiny in the 12 states that require all-party consent for recordings.
