History

Historical Context

The Supreme Court of India struck down the vague Section 66A of the IT Act on 24 March 2015 after Shreya Singhal’s 2012 PIL, ruling the provision—punishable by up to three years’ imprisonment—unconstitutional. Today, Delhi creator Amir Shokeen’s arrest under criminal-harassment charges revives the debate, with Union Minister Kiren Rijiju citing the 2015 decision as a benchmark for balancing free speech and hate-speech controls.
