History

Historical Context

In June 1971 the Nixon administration sought an injunction to stop The New York Times and The Washington Post from publishing the classified Pentagon Papers. The Supreme Court rejected the prior-restraint request in a 6-3 decision, affirming First Amendment protection for the press. That precedent now frames modern disputes over White House press credentials, such as the DOJ’s appeal of CNN’s reinstatement.
